Wyoming Proposes New Out-of-State Private Fish Hatchery and Interstate Transportation Regulations

Courtesy of NAA:

The Wyoming Game and Fish Department will be holding a public meeting to discuss proposed regulation changes on Thursday, May 12, 2022 at 7:00 PM.  You can attend in-person at the Wyoming Game and Fish Headquarters in Cheyenne, Trout Room (enter on east side). The meeting is also available via Zoom.

(Note that when you register you will receive an email invitation. That invitation may say the meeting starts at a time corrected for your location, the meeting definitely starts at 7PM so please disregard that time difference.)

The regulations being presented include:

  • Chapter 49, Private Stocking of Cold-Blooded Wildlife
  • Chapter 51, Private Fish Hatcheries
  • Chapter 69, Importation and Possession of Live Cold-Blooded Wildlife

The proposed regulations are available on the Wyoming Game and Fish Department website: https://wgfd.wyo.gov/Get-Involved/Public-Meetings.

Farms or businesses delivering fish for stocking or traveling through Wyoming with live fish or fertile eggs should review the proposed regulations.  In general, koi, goldfish, and ornamental fish are exempt; however, stocking to state waters is prohibited.

Farms selling live fish for stocking into Wyoming waters should review Chapter 51, Private Fish Hatcheries.

Farms and businesses traveling by truck through Wyoming to deliver fish or fertile fish eggs in another state(s) should review Chapter 69, Importation and Possession of Live Cold-Blooded Wildlife, for the new Interstate Transportation Permit requirements.

Both chapters impose onerous requirements.  The NAA suggests farms and businesses with clients impacted by the proposed regulations should inform their customers they may no longer be able to purchase out-of-state fish, you may not be able to travel through Wyoming to deliver fish or fertile fish eggs to them, or the costs for live fish or fertile fish eggs and/or delivery will increase substantially.

The NAA is preparing comments for the agency. Contact the NAA Office at naa@thenaa.net or 850-216-2400 to share your concerns or questions.
